The Compensation to Victims of Hit and Run Motor Accident Scheme, 2022, notified by the Ministry of Road Transport and Highways on April 1, 2022, stands as a progressive initiative aimed at providing monetary assistance to individuals affected by hit and run accidents. This scheme supersedes the Solatium Scheme 1989, introducing higher compensation amounts and streamlined procedures for the benefit of victims.

Scheme Implementation:

Introduction:

  • The Compensation to Victims of Hit and Run Motor Accident Scheme, 2022, was launched as a successor to the Solatium Scheme 1989.

  • Unlike its predecessor, the new scheme aligns with contemporary needs, with enhanced compensation amounts and an efficient framework.

Enhanced Compensation:

  • Under the Solatium Scheme 1989, compensation for death was Rs. 50,000, and for grievous hurt, it was Rs. 12,500.

  • The revamped scheme increased compensation for death to Rs. 2,00,000 and for grievous hurt to Rs. 50,000.

Fund Administration:

  • Compensation amounts are administered from the Motor Vehicle Accident Fund, established under Section 164B of the Motor Vehicle Act.

  • The fund encompasses accounts for both insured and uninsured vehicles, ensuring comprehensive coverage.

Monitoring Committees:

  • A Standing Committee at the central level oversees, reviews, and administers the scheme's implementation.

  • District Level Committees are established to monitor, take corrective measures, and assess the scheme's progress at the grassroots level.

Claim Application Procedure:

1. Submission of Application: Applicants must submit a duly filled Form I to initiate the compensation claim.

2. Documentary Support: The application should be accompanied by relevant documents, including a claim raised by the treating hospital for cashless treatment payment.

3. Claim Enquiry: The Claim Enquiry Officer scrutinizes the application and assesses the veracity of the compensation claim.

4. Timely Report Submission: The Claim Enquiry Officer submits a report to the Claims Settlement Commissioner within one month of receiving the claim application.

Claim Enquiry Officer's Role:

  • Acceptance of claim applications and obtaining necessary reports.

  • Resolution of rightful claimant disputes.

  • Timely submission of reports to the Claims Settlement Commissioner.

  • Compliance with guidelines for report submission.

Claim Sanctioning:

  • Claims Settlement Commissioner has the authority to sanction claims.

  • Sanction must be issued promptly, not exceeding 15 days from the report's receipt. Any delay in payment prompts the Claims Settlement Commissioner to document the reasons in writing.

  • Deduction of hospital treatment costs from the compensation amount if applicable.

The Compensation to Victims of Hit and Run Motor Accident Scheme, 2022, with its enhanced compensation and streamlined procedures, stands as a significant step toward providing timely and substantial relief to the victims of hit and run accidents. The scheme's meticulous guidelines ensure efficient implementation, reflecting a commitment to the welfare of those affected by such unfortunate incidents.
